Summary:

THIS HEARING was held via videoconference on April 29, 2024.

ON READING the Notice of Hearing dated May 27, 2020 and exhibits filed, including the Statement of Uncontested Facts and Plea of No Contest, and on hearing the submissions of counsel for the parties:

A. THE DISCIPLINE COMMITTEE FINDS that the Registrant has committed acts of professional misconduct pursuant to:

1. Subsection 51(1)(b.1) of the Health Professions Procedural Code, being Schedule 2 to the Regulated Health Professions Act, 1991 specifically:

a. Touching, of a sexual nature, of the patient by the member, and

b. Behaviour or remarks of a sexual nature by the member towards the patient; and

2. Subsection 51(1)(c) of the Health Professions Procedural Code, being Schedule 2 to the Regulated Health Professions Act, 1991, and as defined in the following paragraphs of section 1 of Ontario Regulation 317/12 made under the Psychotherapy Act, 2007:

a. Paragraph 1 – Contravening, by act or omission, a standard of practice of theprofession or failing to maintain the standard of practice of the profession,specifically:

i. 1.5 – General Conduct; and

ii. 1.7 – Dual or Multiple Relationships;

b. Paragraph 52 – Engaging in conduct or performing an act relevant to the practiceof the profession that, having regard to all the circumstances, would reasonably beregarded by members as disgraceful, dishonourable or unprofessional; and

c. Paragraph 53 – Engaging in conduct that would reasonably be regarded bymembers as conduct unbecoming a member of the profession.

B. THE DISCIPLINE COMMITTEE ORDERS THAT:

1. The Registrant is required to appear before a panel of the Discipline Committee to be reprimanded immediately following the hearing by videoconference.

2. The Registrar is directed to revoke the Registrant’s certificate of registration immediately following the hearing.

3. The Registrant is required to reimburse the College for funding provided to the Client under the program required under section 85.7 of the Health Professions Procedural Code being Schedule 2 to the Regulated Health Professions Act, 1991.

4. The Registrant is required to, within one month of the date of this Order, post security acceptable to the Registrar, in the amount of $5,000.00, to guarantee the payment of any amounts she may be required to reimburse the College pursuant to paragraph 3.

5. The Registrant is required to pay to the College costs in the amount of $6,827.00 payable on a schedule to be determined by the Registrar.

Summary:

On January 11, 2018, the Discipline Committee found Elisabeth Melita Haramic committed professional misconduct pursuant to paragraph 42 (contravening the Psychotherapy Act, 2007, the Regulated Health Professions Act, 1991,  or a regulation under either of those acts), namely subsection 3(2) of Ontario Regulation 67/15 under the Psychotherapy Act, 2007; paragraph 42 (contravening the Psychotherapy Act, 2007, the Regulated Health Professions Act, 1991, or a regulation under either of those acts), namely subsection 33(1) of the Regulated Health Professions Act, 1991; paragraph 52 (engaging in disgraceful, dishonourable and unprofessional conduct); and paragraph 53 (conduct unbecoming a psychotherapist) of section 1 of Ontario Regulation 317/12 under the Psychotherapy Act, 2007.

The penalty ordered by the Committee included a reprimand; courses on boundaries, ethics and jurisprudence; monitoring; and psychotherapy.

Professional Conduct Special Notice Caution

On June 5, 2019, the Inquiries, Complaints and Reports Committee required the Member to be cautioned in person.

The College received a complaint about the Member’s communication with clients, maintenance of professional boundaries and representation of services.

The panel believes that attending an in-person caution will impress upon the Member the importance of professional communication and boundaries, while providing her with a remedial opportunity that will assist in her future practice.
